Court indicts Indian national for illegal gun possession

CEBU, Philippines - A 41-year-old Indian national is facing charges before the Regional Trial Court for illegal possession of firearms.

Sandeep Kumar, a native of Malsian Jalandhar, India and is presently residing at V. Rama Avenue, Barangay Calamba, was held for trial by Cebu City Assistant Prosecutor Leah Cruz.

Cruz found probable cause to indict Kumar for violation of the Republic Act 10591 or the Comprehensive Firearms and Ammunition Regulation Act.

Kumar was arrested by elements of Mambaling Police Station around 12 a.m. on October 26 at C. Padilla Street, Cebu City.

Based on the police’s affidavit, they received a call from a concerned citizen informing them about a “drunk” person who allegedly had a handgun tucked in his waist while walking towards his parked car near an eatery.

The police immediately responded to the report and saw Kumar inside his car sleeping with a pistol on his lap.

One of the policemen knocked on Kumar’s car while the rest of them positioned around the vehicle. Kumar reportedly woke up and opened the door of his car as directed by the policeman.

The policeman asked for the necessary documents for the lawful possession of his firearm but Kumar could not produce any.

The police arrested Kumar and confiscated the caliber 45 pistol in his posession loaded with six live ammunitions.

Kumar also underwent a liquor test which showed a positive result.

In an inquest proceeding before Cruz, Kumar chose not to answer the allegations against him and manifested to face charges in court.

Cruz recommended P120,000 for the temporary liberty of Kumar.  (FREEMAN)
