Oral sex suspects out of jail

CEBU, Philippines- The Czech national and the 26-year-old Filipino gay man who were caught engaging in oral sex at a parking lot at Mango Square Mall last Sunday dawn were released from detention yesterday afternoon. 

Police Officer 2 Alexander Terado of the Fuente Police Station said the act was considered a public crime but the two were released because the mall management is not interested in filing a case against them.

The police could have filed two cases – grave scandal for the two men and drunkenness for the Czech national.

Chief Insp. David Señor, acting chief of the Fuente police, also said that before the two were released at past 1 p.m., the Czech consul went to the police station and asked that the case be settled amicably. He then reportedly advised the consul to meet with the management of Mango Square.

This was possible, Señor said, because it was the mall’s security guards who arrested the two men.

“It was a public crime but the security guards were the arresting officers so if the security guards would not show up, there’s nothing we can do. We must release the two,” he said.

But it would have been a different story had the police made the arrest.

“Og pulis na ang arresting officer, dili na pwede i-settle because it was a public crime bisan og walay complainant,” Señor said.

The mall security guards arrested the two men at around 4 a.m. Sunday when they saw the Filipino performing fellatio on the foreigner at the parking lot.

The Filipino admitted the offense but the Czech national denied it, saying he was too drunk to remember if it happened. He said, however, that the Filipino touched him while they were inside a club prior to the arrest.  (FREEMAN)
