CEBU, Philippines - A policeman was indicted for grave threats for allegedly threatening to kill a fellow police officer in Tabuelan last January.
The Cebu Provincial Prosecutor’s Office has found probable cause to elevate before the court the criminal complaints against Senior Police Officer 2 Raymund Jugan. Assistant provincial prosecutor Joe Noel Lawas recommended the filing of the case in court against Jugan after the latter failed to submit his counter-affidavit on the complaint filed by SPO1 Roy Guinita.
Lawas however dismissed the criminal complaint for violation of the Comelec gun ban for lack of evidence. Lawas said the complainant failed to present the firearm which is a vital evidence to prove gun ban violation.
Guinita claimed that Jugan pointed his gun at him on January 26, 2013 at around 5:00 p.m. in Tabunok, Tabuelan, Cebu. The complainant said he was with friends in a store when the suspect approached and challenged him to a fight.
Guinita said he tried to ask the accused what is it that he wants from him but the latter instead pulled out his gun and pointed at him. According to the complainant, Jugan ordered him to draw his gun but he told the accused that he was unarmed because he was off duty when the incident happened.
Lawas said the accused was given time to reply but he failed to prompting him to resolve the complaint based on the evidence at hand.
“In the instant complaint, all the elements of the foregoing punishable act of grave threats are present. Respondent pointed his gun and threatened to shoot or to kill complainant, which is a threat not subject to a condition, to inflict harm upon the person of the complainant,†the resolution reads.— (FREEMAN)
