Talisay policeman Insp. Ricardo Nayne identified the suspect as Roland Cabrillos, who policemen tried to arrest last Thursday with a warrant signed by Regional Trial Court Branch 19 judge Ramon Codilla Jr.

But the suspect saw the police coming to get him and fled from his house. Policemen chased him and shot him in the right thigh when he refused to yield.

"The evidence of the prosecution must not rely on the weakness of the evidence of the defense, but must stand on its own," Codilla's decision read.
