                    [Summary] => CEBU CITY — The city prosecutor’s office has stood by its earlier decision to file criminal cases in court against two suspects in the ambush-killing of a Customs deputy collector and an examiner here in July last year.


In his reinvestigation report, prosecutor Victor Laborte said there is enough evidence to establish probable cause to charge Juan Jesus Vergel de Dios and Rustico Fernandez in the Regional Trial Court. 


Laborte said the alibis of De Dios and Fernandez are matters which the court will determine and decide in a trial on the merits of the case.

The cargo – 45,000 bags of premium rice and 6,000 bags of refined white sugar – was seized from 52 20-foot container vans loaded on three vessels namely, Mary Elizabeth, Pacific Eagle, and Uni-Moral which all arrived at the Port of Cebu last June 22.


The cargo was misdeclared as textile chemicals and consigned to four different persons with addresses in Cebu and Ormoc City, Leyte.
