Habang sinusulat namin ito ay wala pang reaction si Vic Sotto o misis niyang si Pauleen Luna.

Charged na ng two counts of cyber libel sa Muntinlupa Regional Trial Court ang direktor dahil sa umano’y paninirang-puri sa actor/TV host host kaugnay ng trailer ng kontrobersyal na pelikula ng huli na The Rapists of Pepsi Paloma.

Ito ay matapos makita ng city prosecutors office ang merito sa kasong isinampa ni Bossing Vic at papanagutin siya sa paninirang-puri sa huli.

Ang desisyon na kasuhan si Yap sa harap ng RTC ay nakapaloob sa isang resolusyon na may petsang Marso 17 ng city prosecutors office.

Kung maaalala, nagsampa si Sotto ng P35 milyong cyber libel complaint laban kay Yap sa korte.

Ang reklamo sa cyber libel ay dahil pagbanggit ng pangalan ni Vic sa trailer ng pelikula ni Yap bilang isa sa mga rapist diumano ni Pa­loma sa isang confrontation scene ni Gina Alajar kasama ang dating child actress na si Rhed Bustamante.

Ginagampanan umano ni Gina Alajar si Charito Solis, habang si Bustamante ay gumaganap bilang Paloma, na ang tunay na pangalan ay Delia Duenas Smith.

Si Pepsi ay isang dating sumisikat na star nang siya’y diumano’y i-sexually abused ng tatlong showbiz personalities.

Kinampihan ng city prosecutor si Vic na ang pagbanggit ng kanyang pangalan sa trailer ng pelikula ay paninirang-puri dahil itinuring nito na siya ang gumawa ng umano’y krimen.

“The complainant suddenly became the butt of jokes and hate comments that were either lewd or incendiary, which was nothing more than a logical consequence of the controversy sparked by the teaser, since we live in an age where netizens ingratiate themselves with various content on social media on a day-to-day basis,” bahagi ng resolution ni Muntinlupa City Assistant Prosecutor Elvin Keith Barrios.

“We find that the teaser video was defamatory in nature, as it imputed a serious crime upon the complainant, a conclusion supported by the reactions of the viewers themselves,” dagdag niya.

Sinabi pa sa resolusyon na si Vic Sotto ay dumanas ng pangungutya ng publiko at backlash matapos mabanggit ang kanyang pangalan sa trailer ng pelikula.

“The reaction that the teaser video can potentially draw once released, was something that any person could naturally anticipate given the numbers. Such knowledge, combined with respondent’s use of his influence on social media for the purpose of amassing vie­wership and then flaunting it on social media when viewership reached 34 million views, are clear signs of malice,” dagdag pa sa resolution.

Ngunit sinabi ng city pro­secutor na si Yap ay maaari lamang managot sa dalawang bilang ng cyber libel hindi 19 gaya ng reklamo ni Vic.

Ang dalawang kaso ay may kaugnayan sa Republic Act 10175 o ang Cybercrime Prevention Act of 2012 para sa pag-post ng teaser video sa kanyang personal na Facebook page at sa kanyang VinCentiments page.

Maging si Darryl ay wala pang reaction sa kanyang mga social media platform.
