Enteng ng Ina Mo, naka-P91 M na! Resulta opisyal na

SHOWBIZ DRIBBLE - Salve V. Asis -

‘Regal is shocked, dismayed, and deeply hurt by MMFF’s decision to disqualify its entry’

“I’ve been in the movie industry for 51, 52 years. I do my best. I try to input quality films and try to give jobs to stars, directors, and many other things I’ve done in the industry. That’s why I’m still here.

“But for this matter sensitive ako about the issue. Nasaktan ako but I’m not angry. I want to clear matters. How come? Supposed to be I have written them. I want to change the stars, dated November 23. It was there.

“The past revisions were made by producers to improve the quality. To be more interesting and make box-office appeal. This genre is the same. Drama. Family relationships.

“That’s why I’m here to appeal not to fight them. I respect them. Nasasaktan din ako not in terms of money but in terms of credibility. And also my director is a prestigious one! I don’t want to blow up this matter. But I have to serve and protect Regal!

“Ang violation ay they deviated (from the script).

“Regal is shocked, dismayed, and deeply hurt by MMFF’s decision to disqualify its entry: ‘Yesterday, Today and Tomorrow’ from receiving awards in certain categories. The reason cited by MMFF is an alleged major deviation in the storyline.

“It is quite disturbing that the decision was handed out on the very same day as the awards night REGAL was not even informed, not until yesterday (27 Dec. 2011), on any complaint by MMFF with regard to the script and the cast despite the fact that MMFF Execom previewed the entry last 18 Dec. 2011. MMFF’s letter dated 26 Dec. 2011 merely alluded to “certain” deviation without any indication that this was considered “major” under MMFF Rules.

“REGAL wants to make it clear that it committed no violation of the MMFF Rules and Regulations. There was no major deviation in the storyline. While the script was slightly modified, this was done primarily to suit changes in the cast of which MMFF had prior notice as per REGAL’s letter dated 23 November 2011. The genre and essence of the film were never changed. All the necessary elements required by MMFF that will make the final script identifiable with the one originally submitted are in tact.

“The Film Festival is supposed to be an opportunity to unify the film industry. This unfortunate event, however, mars such a beautiful endeavor and unduly limits artistic freedom which was exercised to increase the film’s box office appeal, not for REGAL alone but MMFF as well.

“REGAL thanks the public for continuing to support its movies and the others shown in the Festival as well. This statement is being issued not in the expectation to win but simply to correct an unfair decision which serves no purpose but to divide an already vulnerable industry.”

‘This refers to the claim perpetually made by ABS-CBN in its ratings press releases regarding the case (docketed as No. Q-07-61665) filed against AGB Nielsen Philippines (AGB) in 2007.

Lifted below is a portion of ABS-CBN’s ratings press release that strongly aims to discredit AGB as a ratings service provider in the media industry.

“ABS-CBN shifted to Kantar Media/TNS after filing a case vs. AGB Nielsen Media Research for failing to comply with its request to investigate alleged cheating and data tampering in TV ratings. The case is still pending in court.”

‘This claim was verified to be untrue. The case filed by ABS-CBN against AGB was dismissed by Quezon City Regional Trial Court (RTC) Presiding Judge Charito Gonzales on January 7, 2008 for being prematurely filed. The Court likewise denied the Motion for Reconsideration filed by ABS-CBN in an Order dated June 8, 2009.

‘On January 5, 2010, Atty. Maila Doroteo Santos, Branch Clerk of the Quezon City RTC issued a Certificate of Finality, which confirms the Court’s Decision on the said case as final and executory.

‘ABS-CBN sought relief from the judgment earlier rendered by filing a Petition on ground that “it did not receive” a copy of the June 8, 2009 Order.  RTC Judge Charito Gonzales found the Petition dismissible based on “both substantive and procedural grounds.”

‘In an Order dated October 27, 2010, Judge Gonzales said that “the ‘incoming pleadings’ document presented by the petitioner’s (ABS-CBN) counsel to prove that it did not receive a copy of the Order dated June 8, 2009, besides being self-serving, cannot be said to faithfully reflect all the pleadings received by petitioner’s counsel.” A return card attached to the records of the case evidenced that the Order was duly received by ABS-CBN’s counsel on June 23, 2009.

‘Hence, the Court stated that based on procedu-ral ground, it cannot grant ABS-CBN relief from judgment under Rule 38 of the Revised Rules of Court as it was justly given the opportunity to file an appeal but it did not within the prescribed period.

‘Copies of the Certificate of Finality dated January 5, 2010, and the Orders dated October 27, 2010 and March 21, 2011 are hereby affixed for your further reference.

‘While ABS-CBN may have business reasons to cite the ratings data of Kantar Media in its ratings releases, we are hoping that you can give credence to the ruling of the Court, which renders the above mentioned civil case as closed/dismissed.

‘For the interest of your readers, who deserve only truthful information, we request that you reconsider the continued publication of the aforementioned quote lifted from the ABS-CBN releases.’

Thank you.

 Sincerely,

Butch S. Raquel

“Why is GMA making a comment when it is not party to this case,” ayon kay Mr., Bong Osorio ng ABS-CBN.
