Trader, pinagmulta sa paglabag sa SSS law

Nalalagay sa balag ng alanganing makulong ng 12 taon ang isang store owner sa Bacolod City, Negros Occidental makaraang mapatu­nayan ng mababang korte na hindi nag-remit ng contributions ng tatlong traba­hador sa Social Security System (SSS) sa loob ng siyam na taon.

Sa 9-pahinang desisyon ni Judge Fernando Elumba ng Bacolod City Regional Trial Court Branch 42, pinag­ba­bayad si Florian Dychangco ng P47,886 sa unpaid premiums sa mga kawaning sina Lucy Flores, Lorinda Belando at Monaliza Manla­bao ng Lydias Store simula Hunyo 1992 hanggang Mayo 2001.

“Dychangco will fully, unlawfully and feloniously fails and refuses, without lawful cause, to pay or remit Social Security, Medicare and Employees’ Compensation premiums to the SSS,” pahayag ni Judge Elumba.

Binalewala naman ng korte ang alibi ni Dychangco na hindi sa kanya ang tinda­han at pinunan ang mga tanong sa SSS employer’s data record matapos na ma­irehistro ang tindahan noong 1992.

“It is at the height of absurdity for a businessman like him to accomplish a do­cument and sign it without even bothering to know what it is all about,” dagdag pa ni Judge Elumba.

Naging ebidensya ng pa­ munuan ng SSS ang R-1A form na nilakdaan ni Dy­changco para mairehistro ang kanyang negosyo.

Sinabi ni Atty. Cecilia Sabig, SSS asst. vice president for the Western Visayas Cluster, na maging babala sa mga employers ang conviction ni Dychangco na luma­bag sa SSS law.
