Nauwi na sa legal ang kontrobersiyang kinasasangkutan nina Gabby Concepcion at Mommy Rose Flaminiano. Kung nung una ay puro mga kuwento-kuwento lang ang lumalabas, ngayon ay nag-abogadohan na ang magkabilang panig, pinadalhan ng sulat ni Gabby ang kanyang business manager sa pamamagitan ng kanyang abogadong si Attorney Raymond Fortun.
Isa sa mga dahilan na ibinigay ni Gabby kung bakit gusto na niyang mapawalang-bisa ang kanilang kontratahan ay ang dokumento na ayon kay Gabby ay sabay nilang pinirmahan ni Mommy Rose nung January 2008 sa San Ramon, California, pero nung magpakuha siya ng kopya ng kontrata ay nakita niya na ang petsang “01 day of April 2008” ay nakasulat-kamay lamang at pinalalabas na dito sa Pilipinas nila pinirmahan ang kontrata sa harap ng isang notary public.
Meron din siyang reklamo na hindi diumano tumupad si Mommy Rose sa nakasaad sa kanilang kontrata na aalagaan, iingatan at pananatilihin nito ang magandang imahe ni Gabby, hindi man lang daw siya nakuhang ipagtanggol ng kanyang manager sa mga opinyong nasusulat ngayon tungkol sa kanya, samantalang ang nakasaad sa kontrata ay “to promote, enhance and advance the professional career through good public relations with the movie press, entertainment and movie industry and the movie-going public at large.”
Meron ding kuwestiyon si Gabby tungkol sa kanyang income tax, kinukuwestiyon din niya ang totoong halaga ng kanyang mga tinatanggap na shows, lumalabas na pinapatungan ng kanyang manager ang halagang sinasabi nito sa kanya.
Dahil sa mga ibinigay niyang dahilan ay sinabi ng abogado ni Gabby, “By reason hereof, please be informed that Mr. Gabby Concepcion is rescinding his management contract with you effective IMMEDIATELY, in accordance with Article 1191 of the Civil Code.”

Ang hamon ng abogado ni Mommy Rose, dumulog sa korte si Gabby para dun sumumpa na ang kanilang pinirmahan ni Mommy Rose ay naganap sa San Ramon, California at hindi dito sa Pilipinas, para makasuhan nila si Gabby ng perjury ayon sa itinakda ng Revised Penal Code.

Dear Raymond:
I received your letter dated 09th September 2008, today at 2:20PM on behalf of my client, Mrs. Rosita a.k.a. Rose L. Flaminiano Business/Talent Manager of your client Gabriel a.k.a. “Gabby” Concepcion.
In connection therewith, I would like to inform you that all the allegations in your letter regarding the Management Contract dated 01 April 2008 are highly false, malicious and unfounded. Why do I say so? The Contract was signed in Quezon City, Philippines, NOT in San Ramon, California, sometime in January 2008 as your client wants you to believe.
If your client insists otherwise, you can go to Court and let your client swear under oath that it was signed in San Ramon, California, and not in Quezon City, Philippines, so that we can charge him with the crime of Perjury under the Revised Penal Code, as amended . Your client seems to be under the erroneous impression that he can twist the facts for his convenience. Better advise him not to mess up with the real facts of the case.
I don’t have to answer the rest of the allegations of your letter regarding your client’s alleged problem with the Bureau of Internal Revenue (BIR). Moreover, there is no iota or scintilla of truth in the information conveyed to you that my client “threatened to report him to the BIR should he try to terminate or cause the amendment of the Management Agreement. You don’t really have to state or accentuate the obvious. My client as the Business/Talent Manager of Gabby Concepcion has not failed to look after the best interests of your client, Gabby Concepcion.
Your baseless, unfounded, and malicious accusation in your letter that my client is threatening your client with arrest is really “a serious breach of her contractual commitments to promote, enhance and advance his professional career”. But this accusation unfortunately is a patent and enormous lie which your client is purveying and retailing to people including you as his lawyer.
With this comment or answer to your letter, I am, indeed, saddened to tell you and to your client that my client is ready to face any civil or criminal suit that you may intend to file against her. She is ready, willing, and able to answer all the baseless, unfounded, and malicious accusations levelled against her by your client merely in his ardent desire to evade his professional responsibility under the Management Contract dated 01 April 2008 he signed with his Business/Talent Manager in the hope that he will make more money without a Business/Talent Manager who receives a commission of 20% on all his professional engagements except his Contract with ABS-CBN Star Cinema Films, Inc. where my client does not receive a single centavo of commission.
Here to attached are Xerox copies of the various write-ups regarding the recent actuations of your client for your personal and legal information and guidance. These write-ups are self explanatory in nature and character.
