Online sellers, exempted na sa buwis - BIR
MANILA, Philippines — Inanunsyo ni Bureau of Internal Revenue Commissioner Romeo D. Lumagui Jr. na “exempted” na sa creditable withholding tax ang mga “small-scale” online sellers sa ilalim ng Revenue Regulation No. 16-2023 at Revenue Memorandum Circular No. 8-2024.
Ayon kay Lumagui na ito ay may kinalaman sa Creditable Withholding Tax na 1 percent sa one-half (1/2) ng gross remittances ng e-marketplace operators at digital financial services providers sa sellers o merchants na naibebenta at nababayaran sa pamamagitan ng kanilang platform/facility.
Ang mga sumusunod na sellers o merchants na exempted sa naturang buwis ay kung ang annual total gross remittances ng online seller/merchant sa nagdaang taxable year ay hindi lalampas sa P500,000, kung ang cumulative gross remittances ng online seller o merchant sa taxable year ay hindi lalampas sa P500,000.00 at kung ang seller o merchant ay duly exempt mula sa lower income tax rate alinsunod sa anumang umiiral na batas.
“For those who are above the threshold of P500,000 annual gross remittance, it is only fair that they will be subjected to withholding tax. We have to be fair to the retail sector and brick and mortar stores who are regularly paying their taxes. If you have a business, you have to register and pay your taxes. It doesn’t matter if it’s an actual store or an online store. It is your responsibility to pay taxes like everyone else,” paalala ni Lumagui.
Ang RR No.16-2023 at RMC No. 8-2024 ay mga regulasyon na naipalabas ng BIR tungkol sa withholding tax ng mga online sellers hinggil sa definitions, taxations, at obligasyon ng online sellers at online platforms hinggil sa withholding tax system.
Inatasan na ni Lumagui ang lahat ng tauhan sa BIR na bigyang kaalaman at asistihan ang mga online sellers at online platforms hinggil sa kanilang tax obligations.
