PCSO inatasang sumunod sa CA order sa ‘Peryahan’ games

MANILA, Philippines — Inatasan ng Office of the Government Corporate Counsel (OGCC) ang Philippine Charity Sweepstakes Office (PCSO) na sundin ang kautusan ng Court of Appeals (CA) na payagan ang operasyon ng Peryahan Ng Bayan (PNB) habang nireresolba ang legal na usapin kaugnay ng pagtigil sa kanilang kontrata.

Sa isang legal opinion, sinabi ng OGCC na dapat nang sumunod agad ang PCSO sa utos ng CA’s eighth division “to continue sending a representative daily to the draw centers of Globaltech for the conduct of the Peryahan Games” na binalewala umano ng ahensya.

“PCSO has to immediately comply with the CA’s directive, otherwise, the Board of Directors is vulnerable to indirect contempt,” ayon sa limang pahinang liham mula kay Assistant Government Corporate Counsel Efren Gonzales.

Sa nasabing desisyon nitong Jan. 15, pinagtibay ng CA ang status quo ante order (SQAO) na inilabas ng Pasig City regional trial court (RTC) branch 161 noong May 2016 na pumipigil sa pagpapawalang bisa ng PCSO sa deed of authority (DOA) ng Globaltech para sa operasyon ng PNB.

Inutusan din ng CA ang PCSO  “to forthwith submit themselves to arbitration conformably with the terms of their written agreement.”

Ayon sa OGCC, abogado ng government owned and controlled corporations, kahit na may pagkakataon pang umapela ang PCSO o makipag-areglo na lamang sa Globaltech, kailangan nitong sumunod sa kautusan ng korte.

Dahil dito, inatasan ng OGCC ang PCSO na magpadala na ng kinatawan sa PNB draws at itigil na muna ang pag-aresto sa mga tauhan ng Globaltech.

“With the SQA being immediately executory, PCSO has to suspend temporarily affecting arrests, search and seizure, through the National Bureau of Investigation’s and Philippine National Police’s assistance, against operators of the Peryahan Games for illegal gambling,” dagdag pa nito.

Maaaring maghain ng apela ang PCSO hanggang Feb.13. Ngunit napag-alaman na nabigo itong makapag sumite-ng motion for reconsideration sa naturang deadline.

Inilibas ng OGCC ang naturang legal opinion sa request ni PCSO general manager Alexander Balutan.
