Case vs cop who shot minor to be filed today

CEBU, Philippines - Charges are expected to be filed against Chief Insp. Ceferino Tabay today following two tests to support the case against him for shooting his daughter’s boyfriend in Bogo City last Friday afternoon.

Tabay was subjected to a paraffin test while his 9mm service pistol was submitted for ballistic examination at the Crime Laboratory 7 in Camp Sotero Cabahug last Saturday.

PO3 Mary Joy Ylanan, Women’s and Children’s Desk Officer, said the two tests were necessary to support the criminal case against Tabay. The case will be filed before the Regional Trial Court in Bogo City today.

Tabay, the deputy police chief of Bogo City, was accused of shooting Vincent Paul Montesclaros, the boyfriend of Tabay’s 16-year-old daughter.

As of yesterday, the boy’s remains were not yet subjected to autopsy owing to the request of the Montesclaros family for the National Bureau of Investigation to conduct a separate investigation.

Insp. Julius Ompad, legal counsel of the Cebu Provincial Police Office, said the affidavits of the policemen who responded to the incident last Friday have been prepared.

“Wala pa sad ko kahibalo ug unsa gyuy kaso pero andam na ang affidavits sa niresponde ngadto,” Ompad said.

The FREEMAN tried to get Tabay’s reaction on the request of the victim’s family to have him undergo a drug test, but the police refused to let him issue any statement yesterday as his legal counsel was not around.

The victim’s parents, Paul and Lilibeth, had alleged that Tabay tortured their son first before he shot him repeatedly. Injuries were found the victim’s face.

Tabay claimed to have committed the crime purely out of fatherly love to daughter when he saw her nose bleeding. He reportedly shot the victim dead at a shanty in Barangay Guadalupe. Tabay said the boy was reportedly armed at that time, which prompted him drew his pistol and shot at the victim to defend himself.

Tabay, however, regretted what happened and said he is ready to face any investigation against him.

Bogo City Police chief, Supt. Anthony Bagarinao, assured the Montesclaros family that they will handle the case impartially. Tabay is currently detained at the station’s stockade like any other crime suspect. — (FREEMAN)
