DOJ 'takang-taka' sa ICC probe resumption kahit sisiliping kaso nangyari noong miyembro pa Pinas

MANILA, Philippines — Iginiit ng Department of Justice na walang jurisdiction ang International Criminal Court sa pag-iimbestiga sa "crimes against humanity" ni dating Pangulong Rodrigo Duterte atbp. pagdating sa human rights abuses — ito habang idinidiing pagtapak ito ng soberanya ng Pilipinas.

Pinayagan na kasi ng Pre-Trial Chamber I ng ICC ang hiling na ituloy ang noo'y suspendidong imbestigasyon sa madugong "war on drugs" ni Digong. Hindi kasi sila nasapatan sa mga hakbang ng gobyerno upang harapin nang seryoso ang pag-abuso.

"I don’t get it. Why they insist on entering the Philippines instead of the fact that we are no longer members. And that the principle here is... it’s either us or them," ani Justice Secretary Jesus Crispin Remulla, Biyernes, sa isang press briefing.

"[W]e are a fully functioning judicial system. I don’t see where they will come in. What role they will play, unless they want to take over our legal system or they want to take over our country. and I don’t see that happening."

Tinutukoy ni Remulla ang pormal na pagkalas ng Maynila sa Rome Statute, ang tratadong gumawa sa ICC, noong Marso 2019.

Ang ICC ay isang body na itinayo para imbestigahan at litisin ang mga indibidwal na pinararatangan ng hebigat na krimen gaya ng "genocide," "war crimes," "crimes against humanity" at "crime of aggression."

Last resort lang dapat ang ICC lalo na kung hindi gumagana nang maayos ang sistema ng katarungan sa bansa ng pinararatangan, at designed para tumulong at hindi palitan ang local courts.

Nang matanong kung makikipagtulungan sila kung sakaling maglabas ng arrest warrant laban kay Duterte, binanggit ng kalihim ng DOJ na walang kapangyarihang maghain ng subpoena ang ICC sa Pilipinas.

"I will speak to the Solicitor General [Menardo Guevarra] about the course of action that we will take as a country here," dagdag pa ni Remulla.

"Definitely, I do not welcome this move of theirs. And I will not welcome them to the philippines unless they make it clear that they will respect us in this regard. I will not stand for any of this antics that will tend to question our sovereignty, our status as a sovereign country. We will not accept that."

Hindi pa nakakausap ng DOJ official si Pangulong Ferdinand Marcos Jr. patungkol sa isyu, ngunit dati nang sinabi ng presidenteng wala siyang balak ibalik sa ICC ang Pilipinas. Bise presidente ni Bongbong si Sara Duterte, na anak ni Digong.

Kanina lang banggitin ni Guevarra, na tumatayong abogado ng gobyerno, na iaapela ng estado ang desisyon ng ICC sa anti-drug campaign, na siyang pumatay na sa mahigit 6,000 (mahigit 30,000 sa datos ng iba).

Ang iba rito, mga extrajudicial killings kung saan napatunayang inosente at hindi nanlaban ang napatay gaya ng sa kaso nina Kian delos Santos, Carl Angelo Arnaiz at Reynaldo "Kulot" de Guzman.

Ano ba iimbestigahan ng ICC? Jurisdiction?

Sa kabila ng paghihimutok ni Remulla, walang balak ang ICC na imbestigahan ang mga human rights abuses at EJKs noong panahong hindi na party sa Rome Statute ang Pilipinas.

Ang tanging uusisain ng international court ay ang mga pang-aabusing nangyari sa Pilipinas simula ika-1 ng Nobyembre 2011 hanggang ika-16 ng Marso 2019.

"The Philippines, State party to the Rome Statute since 1 November 2011, deposited a written notification of withdrawal from the Statute on 17 March 2018," paliwanag ng ICC.

"While the Philippines' withdrawal from the Statute took effect on 17 March 2019, the Court retains jurisdiction with respect to alleged crimes that occurred on the territory of the Philippines while it was a State Party."

Kanina lang nang sabihin ni Harry Roque, dating tagapagsalita ni Duterte, na hindi raw hahayaan ng dating presidente na husgahan siya ng mga banyaga hangga't kaya naman ng mga lokal na korteng gawin ito.

'Magandang balita ito'

Malugod na tinanggap naman ng human rights group na Karapatan ang bagong hakbangin ng ICC pre trial chamber, bagay na tinawag nilang "welcome news."

"We hope that the ICC pre trial chamber pursues investigation until former Pres. Rodrigo Duterte is convicted and punished for the deaths of thousands in his regime's bloody anti-drug war," sabi nila sa isang pahayag. 

"This should also serve as a warning to the current [Marcos] regime for essentially continuing Duterte's policies on the drug war."

Aniya, malaki raw ang maitutulong ng ganitong international mechanisms upang mabigwasan ang "culture of impunity," o 'yung kultura kung saan walang nananagot, na siyang matagal na raw sagabal sa katarungan.

Umaasa ang militanteng grupo na mahihikayat ng ganitong pananaw ng ICC ang isang independent investigation ng United Nationals Human Rights Council pagdating sa sitwasyon ng karapatang pantao sa bansa.
