UP pinababawi pag-atras ng DND sa pagbabawal ng pulis, militar sa campus

MANILA, Philippines — Kinundena ng pamunuan ng Unibersidad ng Pilipinas (UP) ang pagbasura ng Department of National Defense (DND) sa isang kasunduang nagbabawal sa panghihimasok ng pulis at militar sa kanilang mga campus, bagay na makaka-apekto diumano sa "academic freedom" at malayang pag-iisip na itinataguyod ng institusyon.

Lunes nang isapubliko ang liham ni Defense Secretary Delfin Lorenzana na pumuputol sa UP-DND Accord of 1989, bagay na ginagawa raw ng gobyerno para "protektahan ang kabataan" mula sa Communist Party of the Philippines-New People's Army (CPP-NPA) recruitment.

"[G]iven our experience of martial law, we must reject any form or semblance of militarization on our campuses, which will have a chilling effect deleterious to academic freedom. This abrogation endangers the goodwill necessary for both of us to achieve our mission as responsible members of the same national family," ani UP president Danilo Concepcion, Martes, sa isang statement.

"May I urge you, therefore, to reconsider and revoke your abrogation, and request further that we meet to discuss your concerns in the shared spirit of peace, justice, and the pursuit of excellence."

Aniya, ginawa ito ni Lorenzana nang walang konsultasyon at makaisang-panig, bagay na napag-usapan daw sana. Gayunpaman, magbubunsod lamang daw ng kalituhan at duda sa pulis at militar ang aksyon ng pamahalaan, dagdag ni Concepcion.

Matagal nang nire-redtag bilang rebelde ang ilang aktibistang estudyante, propesor at miyembro ng naturang komunidad, kahit hindi naman humahawak ng armas ang karamihan sa kanila.

Ano ba ito?

Taong 1989 nang pirmahan nina dating Defense Secretary Fidel Ramos at dating UP president Jose Abueva ang nasabing kasunduan para protektahan ang academic freedom, na siyang gumagarantiya sa kalayaan sa paniniwala at pagpapahayag.

Bagama't binabawalan ang Armed Forces of the Philippines (AFP) at Philippine National Police (PNP) sa ilalim ng kasunduan, merong sariling pulis ang UP. Pinapayagan din ang mga operasyon sa eskwelahan basta't may pahintulot ng pamantasan.

"Our police and military authorities should have no fear of academic freedom. Indeed UP has bred rebels and nonconformists—as well as it has bred presidents, senators, congressmen, and business, civic, and even military leaders," dagdag ng UP president.

"All the world’s great universities have produced the same range of thinkers and doers. By and large, intellectual and political dissidents in UP have always been in the minority, but it is a critical minority that has historically been vital to the maintenance of a healthy democracy."

Dagdag pa niya, produkto ng academic freedom ang excellence ng nasabing pamantasan, na siyang ika-65 sa 489 unibersidad sa buong Southeast Asia, ayon na rin sa Times Higher Education Asia University Rankings.

Bakit may ganoong kasunduan?

Ayon kay Renato Reyes Jr., secretary general ng Bagyong Alyansang Makabayan (BAYAN) at isa ring UP student noon, nilagdaan ang UP-DND accord matapos pwersahang isakay sa sasakyan sa Vinzons Hall ang isang staffer ng Philippine Collegian (Donato Continente), isang pahayagang pangkampus, noong ika-16 ng Hunyo, 1989.

"This triggered discussions on the conduct of military operations on campus. Donat was accused of involvement in the killing of a top US military official in the Philippines, Col. James Rowe of the JUSMAG," ani Reyes.

Nauna nang nagkaroon ng kasunduan ang state forces sa komunidad ng UP na hindi manghihimasok sa nasabing paaralan nang walang pahintulot ang militar at pulis nang lagdaan ang 1982 Soto-Enrile Accord, sa pagitan ng student leader na si Sonia Sotto at dating Defense Minister Juan Police Enrile.

Abogado: Walang batayan 'yan

Pinalagan din ni Antonio Lavinia, lecturer sa UP College of Law, ang ginawa ni Lorenzana at sinabing "wala itong batayan sa batas."

Sa ulat ng alternative press na Bulatlat, sinabi niyang parte lamang daw ito ng krusada ng gobyerno na "patahimikin" ang sinumang sumasalungat sa pananaw ng gobyerno.

"DND, in its letter, has failed to show any overriding public interest to interfere with UP’s academic freedom. It did not show any clear and present danger which can limit a student or a professor’s civil liberty to freely think and express his or her view," ani Lavinia, na dati ring presidente ng UP Law Student Government nang lagdaan ang accord.

"The letter just red-tagged students who are fearlessly standing up for what they believe in."

Kasama aniya sa academic freedom, na nakasaad sa charter ng UP (Republic Act 9500), na may kalayaan ang pamantasang magdesisyon sa sarili nang hindi pinipilit ng mga panlabas pwesa maliban kung kinakailangan ng public interest.

Tanong pa niya, kung walang intensyon ang DND na magpadala ng pulis at sundalo sa UP, bakit pa kailangang kanselahin ang 1989 Accord.

Una nang sinabi ni Loirenzana na ginagamit aniya ng CPP-NPA ang naturang kasunduan bilang "shield" para hindi mapigilan ang law enforcers gumawa ng mga operasyon.

'Safeguard sa warrantless arrest'

Kinastigo rin ni Bise Presidente Leni Robredo ang naturang aksyon ni Lorenzana, lalo na't tatlong dekada na raw pumoprotekta sa warrantless arrests gaya ng ginawa kay Continente noong 1989 sa loob ng eskwelahan.

"The unilateral scrapping of the decades-old Accord sends [this] message: That under this administration, anyone, anywhere, at anytime, is fair game," wika niya sa isang pahayag.

"It is now up to us to decide where we will give in. Or whether at long last, we will stand our ground and speak out."

Para naman sa Bayan Muna party-list, sinyales lang ito na ayaw nilang gawang lugar ng "critical thinking" at protesta ang pamantasan upang mas madali itong gipitin.

"As it is, the UP community, the alumni of the premier state university,  along with all freedom loving Filipinos should condemn and fight back and would not let this fascist move come to pass," ani Bayan Muna Rep. Carlos Zarate.
