MANILA, Philippines — Itinanggi ng Malacañang na papasok sa lahat ng bahay para maghanap ng coronavirus disease (COVID-19) patients ang Philippine National Police (PNP), kasunod ng anunsyo ni Interior Secretary Eduardo Año na "magbabahay-bahay" ang otoridad para sa mga positibo sa virus.

Miyerkules nang ilinaw ni presidential spokesperson Harry Roque ang bagong polisiya ng gobyerno hinggil sa mga mild at asymptomatic cases, na noo'y pinapayagang magpagaling sa kanya-kanyang tahanan.

"We don't have a provision for house-to-house, only the political critics of the government again weaponizing this very important task of tracing," wika ni Roque sa panayam ng ANC.

"They will have to be reported by the persons themselves, their family or the barangay. There is a law which is R.A. 11332, which says we have to report communicable diseases."

Umani ng batikos mula sa iba't ibang grupo ang plano ng Department of the Interior and Local Government (DILG) matapos sabihin ni Año na magbabahay-bahay ang mga pulis para hanapin ang mga mild at asymptomatic COVID-19 patients, bagay na "tokhang style" diumano sabi ng ilang kritiko.

Pero banggit ni Roque, may "police power" ang estado na kunin ang mga pasyente nang pwersahan kung kinakailangan dahil isyu ito ng public health: "It's a very communicable disease. And if they refuse to be isolated, the state of course can of course isolate them."

"We prefer that the asymptomatics and the mild cases voluntarily surrender and confine themselves in isolation centers," sabi ng tagapagsalita ng presidente. Hindi naman daw sila ilalagay sa mga kulungan ngunit sa mga mala-hotel na pasilidad.

"We're enticing them that these are airconditioned centers, free lodging, free meals three times a day and with free WiFi. And with a graduation ceremony to put after the 14-day quarantine period."

Aniya, nananatiling nasa 40-50% ang mga isolation facilites dahil hinayaan ng gobyerno magpagaling ang mild at asymptomatic COVID-19 carriers sa bahay. Gayunpaman, dini-discourage na ito ng gobyerno sa dahilang maaaring mahawaan ang mga kasama nila sa bahay. Magtatalaga rin naman ng mga nurse at doktor sa mga naturang pasilidad para mas maalagaan ang mga pasyente.

Klinaro naman ni Joint Task Force COVID Shield head Lt. Gen. Guillermo Eleazar na mga local government units (LGUs) ang mangunguna sa operasyong ito, at saka lamang tatawagin ang PNP.

"Hindi po kami ang mangunguna dito. Hindi po kami ang magkukusa, magsasarili na kakatok sa mga bahay. Maghihintay po kami sa guidance at request ng LGU... Hindi po namin kabisado kung sino ang mga positive d'yan... Ang dami po naming ibang ginagawa ngayon," wika ni Eleazar sa panayam ng ABS-CBN TeleRadyo.

Kahapon lang nang sabihin ng DILG sa isang press conference sa Taguig City ang naturang plano, lalo na't ipinagbabawal na ang home quarantine.

"Ang gagawin natin, sa tulong ng ating LGUs at Philippine National Police ay iba-bahay-bahay po natin ‘yan at dadalhin natin ang ating mga positive sa ating COVID-19 facilities," sambit ni Año.

Pinalagan na ng mga legal at human rights groups ang mungkahi ng gobyerno, sa dahilang labag daw ito sa Article III Section 2 ng 1987 Constitution, bagay na prumoprotekta sa publiko mula sa 'di makatarungang panghihimasok at paghalughog ng bahay.

"The right of the people to be secure in their persons, houses, papers, and effects against unreasonable searches and seizures of whatever nature and for any purpose shall be inviolable, and no search warrant or warrant of arrest shall issue except upon probable cause to be determined personally by the judge after examination under oath or affirmation of the complainant and the witnesses he may produce, and particularly describing the place to be searched and the persons or things to be seized."

Ayon sa National Union of People's Lawyers (NUPL), pagpapakita lamang na nananatiling militarista ang approach ni Pangulong Rodrigo Duterte sa pandemya.

"Although we are calling on the government to apply the find, test, treat and isolate strategy, arming law enforcers with another tool to sow fear in our communities and trample on our rights — with a draconian Terror Law in the horizon — is worrying and disturbing," sabi ng NUPL.

Pero sinagot naman 'yan ni Roque, na isa ring dating human rights lawyer: "I don't think so. There is inherent police power that is the very assumption to establishment of the state. And if it is to protect public health, I think the isolation can be justified."
