Duterte 'walang problema' sa 24-araw na kulong bago kasuhan sa anti-terror bill

MANILA, Philippines — Wala aniyang nakikitang mali ang Pangulong Rodrigo Duterte sa 14 hanggang 24 araw na "pre-trial detention" na nakapaloob sa kontrobersyal na anti-terrorism bill, bagay na inaantay na lang kung pipirmahan niya o hindi.

Kung aaprubahan ni Duterte, pwedeng ikulong nang lampas dalawang linggo ang isang terror suspek kahit na hindi pa nakakasuhan, nililitis ng korte at nabibigyan ng warrant of arrest.

"Let's just say that as a trial fiscal, there's one issue that he [Duterte] has no problems with, and that is pre-trial detention," sabi ni presidential spokesperson Harry Roque sa panayam ng ANC, Miyerkules nang umaga.

"Even under the existing Revised Penal Code, there is a period of up to 36 hours that authorities who are [arresting] persuant to a warrantless arrest can [detain]."

Sabi ni Roque, na isa ring abogado, ginagawa ang mga ito para maiwasan ang pagtakas ng suspek o pagsira niya sa ebidensya.

Sa ilalim ng Article VII Section 18 ng 1987 Constitution, sinasabing dapat pakawalan ang sinumang inaresto kung hindi makakasuhan sa loob ng tatlong araw kahit na suspendido ang writ of habeas corpus.

"During the suspension of the privilege of the writ of habeas corpus, any person thus arrested or detained shall be judicially charged within three days, otherwise he shall be released."

Dagdag pa ni Roque, kahit na maisabatas ang anti-terror bill ay susundin naman ang mga panuntunan ng korte pagdating sa warrantless arrests, na hinihinging may personal na kaalaman sa krimen ang mang-aaresto o nakita nang personal ang suspek habang nilalabag sa batas: "Because if you deviate from that, you would have serious legal problems."

Depensa pa niya, "constitutional" raw ito sa pananaw ni Duterte sa dahilang korte pa rin naman daw ang maglalabas ng warrant of arrest, na gagamitin tuwing mag-aaresto o kung aakuin na nila ang jurisdiction sa inaakusahan.

Pinapalagan ngayon ng ilang grupo't mga abogado ang anti-terrorism bill sa dahilang "unconstitutional" daw ito at maaaring magamit din hindi lang aniya sa mga terorista ngunit pati sa mga kritiko ng pamahalaan.

Hindi ATC council ang magdedeklara ng terorista?

Maliban sa isyu ng warrant of arrest at pagkakaso, inirereklamo ng Integrated Bar of the Philippines (IBP) at iba pa na inaagawan diumano ng Anti-Terrorism Council (ATC) ang mga korte ng trabaho, bagay na pagtakpak diumano ng ehekutibo sa lehislatura na unconstitutional.

Sa ilalim kasi ng Section 25 ng anti-terror bill, may kapangyarihan ang ATC na magdeklara kung sino ang terorista. Sila ang magdedesisyon pagdating sa probable cause at hindi korte.

"The ATC may designate an individual, groups of persons, organization, or association, whether domestic or foreign, upon a finding of probable cause that the individual, groups of persons, organization, or association commit, or attempt to commit, or conspire in the commission of the acts defined and penahzed under Sections 4, 5, 6, 7. 8, 9, 10, 11 and 12 of this Act."

Pero ikinaila 'yan ni Roque at sinabing dapat maghahain muna ng petisyon sa Court of Appeals bago maideklarang terorista ang isang grupo.

"We beg to disagree because it is still the courts that would designate a person as a terrorist organization. In fact, you have to file a petition with the Court of Appeals and not just with the Regional Trial Court," sabi niya, kahit na pumapatungkol naman sa "proscription" o pagdedeklarang iligal ng isang grupo ang kanyang binabanggit — bagay na ibang proseso pa.

Una nang sinabi ni Roque na malaki ang posibilidad na pirmahan ni Duterte ang panukalang batas, ngunit nais pa raw niyang masilip ito nang personal isa hanggang dalawang araw matapos matanggap ang mga rekomendasyon ng Office of the Executive Secretary.
