Malversation, graft dapat ikinaso kina Aquino, Abad – Palasyo
MANILA, Philippines — Naniniwala ang Palasyo na dapat mas mabigat na kaso ang isinampa ng Ombudsman laban kina dating Pangulong Benigno Aquino III at dating Budget Sec. Florencio Abad sa halip na usurpation of legislative powers kaugnay sa pagpapatupad nito ng Disbursement Acceleration Program (DAP) ng nakaraang administrasyon.
Sa ilalim ng article 239 ng Revised Penal Code, ang usurpation of legislative powers ay may parusang 6 na buwan at isang araw na kulong, pansamantalang disqualification at multang hindi lalampas sa P1,000.
Ayon kay Presidential Spokesman Harry Roque, ang dapat ikinaso ng Ombudsman kina Aquino at Abad ay malversation at graft sa halip na usurpation of legislative powers.
“It was a very serious breach of the Constitution and I think charging him with something that would entail imprisonment of 6 months, which is probationable, is not proportionate to what the Court decided,” sabi ni Roque.
“There’s a decision of the Supreme Court that the Constitution was violated. I don’t understand why it took all this time to charge him finally criminally and literally a month before she retires,” sabi pa ni Roque.
Hindi rin kuntento si Sen. Richard Gordon sa kasong usurpation of powers na isinampa kina Aquino at Abad.
Paliwanag ni Gordon, dapat ay kasama ang kasong technical malversation dahil pinakialaman umano nina Aquino at Abad ang pondo sa pamamagitan ng pagdedeklara rito na savings upang magamit sa ibang paraan.
