Dahil sa itinapong toxic waste sa Subic… VFA, pinababasura ni Miriam!

MANILA, Philippines - Sa gitna ng napaulat na pagtatapon ng hazar­dous wastes sa Subic Bay ng isang U.S. Naval ship, muling binuhay ni Senator Miriam Defensor-Santiago ang kaniyang panawagan na ibasura na ang Visiting Forces Agreement (VFA) sa pagitan ng Pilipinas at ng Amerika.

Sa talumpati sa annual convention ng Philippine Academy of Medical Specialists kahapon sinabi ni Santiago na maghahain siya ng isang resolusyon na mag-aatas sa Secretary of Foreign Affairs (DFA) na magbigay ito ng “notice of termination of VFA” sa Amerika.

Ayon kay Santiago, nabigo ang Amerika na sumunod sa Philippine law at international norms at customs na protektahan ang kalikasan.

 “I charge the United States for failing to comply with, and for violating, Philippine law, as well as international norms and customs on the protection and preservation of the environment as these obligations are now codified respectively in articles 192 and 211 of the U.N. Convention on the Law of the Sea,” ani Santiago.

Ayon sa resolusyon, dapat ikonsidera ng gobyerno ang Vienna Convention on the Law of Treaties lalo na ang Article 64 kung saan isinasaad ang grounds ng termination ng isang treaty at ang Article 53 kung saan ibinibigay naman ang ground ng invalidity.

Sinabi rin ni Santiago na ang  Glenn Defense Marine Asia, ang kompanya na diumano’y nagtapon ng toxic waste ay maituturing na civi­lian personnel na kinuha ng United States armed forces sa ilalim ng Article I (2) ng  VFA.

Maituturing aniyang breach of obligation ng international law ang ginawang ilegal na pagtatapon ng basura sa Subic ng Glenn Marine Asia.
