Implementasyon ng Batas Kasambahay
NAPAGKUWENTUHAN namin ni Senate President Pro Tempore Jinggoy Ejercito Estrada ang Implementing Rules and Regulation (IRR) ng Batas Kasambahay. Si Jinggoy ang author at main sponsor ng naturang batas na nagtitiyak ng kapakanan at kagalingan ng mahigit dalawang milyong kasambahay (maid, driver, yaya, hardinero, tagaluto at iba pang katuwang sa gawaing-bahay).
Mahigpit na ipinagbabawal ng batas na ito ang “physical, sexual, psychological harm or economic abuse (e.g. withholding of wages), including threats of such acts, batÂtery, assault, coercion, harassment or arbitrary deprivation of liberty†sa mga kasambahay. Itinatakda ng IRR ang proteksiyon pati ang “rescue and rehabilitation†ng mga inaabusong kasambahay, gayundin ang sistema at mekanismo para rito, tulad ng mga sumusunod: “…any abused household helper shall be immediately rescued by a municipal or city social welfare officer in coordination with the concerned barangay officials and law enforcement personnel. The local social welfare and development offices (LSWDOs) are mandated to make available the following services for the abused kasambahay: temporary shelter, counseling, free legal services, medical or psychological services, livelihood and skills training, among others.â€
Ito ay isa lang sa napakaraming positibong probisyon ng nasabing batas para sa mga kasambahay kabilang din ang pagtitiyak ng kanilang 13th month pay, membership sa PhilHealth, Social Security System (SSS), PagIBIG at Employees Compensation Commission (ECC), pagkakaroon ng malinaw at detalyadong kontrata sa trabaho, sapat na pagkakataon sa pakikipagkomunikasyon at pakikisalamuha, at karapatan sa kanilang kabuuang pag-unlad.
