DAPAT magkaroon ng kapangyarihan ang impeachment court at iba pang kinauukulang otoridad na mabusisi ang anumang foreign currency deposit ng mga opisyal ng pamahalaan na iniimbestigahan sa kasong katiwalian.
Ito ang iginiit ng aking anak na si Senate President Pro Tempore Jinggoy Ejercito Estrada sa kanyang Senate Bill 3120 na naglalayong amyendahan ang apat-na-dekada nang Republic Act 6426 (Foreign Currency Deposit Act of the Philippines). Batay sa naturang batas na pinagtibay noong Abril 1974, “all foreign currency deposits are considered of absolutely confidential nature except upon the written permission of the depositor; …no instance shall foreign currency deposits be examined, inquired or looked into by any person or government office whether judicial, administrative or legislative, or any other entity.”
Pero napansing ginagamit ng ilang opisyal ng pamahalaan ang RA 6426 upang maitago ang kanilang illegally acquired wealth. Kapag na-convert kasi nila sa dollar account o anumang foreign currency deposit ang kanilang nakaw na yaman ay hindi na ito puwedeng mabusisi ng mga otoridad dahil nga sa “confidentiality provision” ng nasabing batas. Ang nasabing probisyon umano ay nagiging hadlang sa pagtitiyak ng “transpa-rency and accountability” sa serbisyo-publiko.
Matatandaang naging isyu ang naturang confidentiality provision sa kasalukuyang impeachment trial partikular sa umano’y mga dollar account ni Chief Justice Renato Corona.
Kapag napagtibay ang panukalang amyenda ni Jinggoy, ang mga foreign currency deposit ng mga opisyal ng pamahalaan ay puwede nang mabusisi sa bisa ng “order of an impeachment court or any competent court on cases involving public officials charged with the violation of Republic Act 3019 or the Anti-Graft and Corrupt Practices Act.”
Saklaw ng panukala ang lahat ng public officials, kabilang ang mga impeachable officers tulad ng presidente ng ban sa, bise-presidente, Ombudsman at mga opisyal ng Supreme Court at Constitutional Commissions.
