Paglaban sa cybercrime

MARAMI ang nag-aantabay sa pagsasabatas ng panukalang “Cybercrime Prevention Act of 2012” (Senate Bill No. 2796). Ito ay pinagsanib na mga magkakaugnay na panukala ng mga senador. Kabilang dito ang iniakda ng aking anak na si Senate President Pro Tempore Jinggoy Ejercito Estrada na “Anti-Cyber Squatting Act” (SB 665) at “Philippine VOIP (Voice Over Internet Protocol) Act.” (SB 828).

Layon ng SB 2796 na bigyan ng sapat na kapangyarihan ang mga otoridad na imbestigahan at i-prosecute ang sinumang indibiduwal o grupo na nagsasagawa ng mga “internet-related crime o cybercrime” tulad ng fraud, hacking at cybersex. Ilan sa mga partikular na ganitong uri ng gawain ang mga sumusunod: (1.) Offenses against the confidentiality, integrity and availability of computer data and systems (illegal access, illegal interception, data interference, system interference, cyber-squatting, misuse of devices); (2.) Computer-related offenses (computer-related forgery, computer-related fraud); (3.) Content-related offenses (cybersex, child pornography, unsolicited commercial communications, libel).

 Kabilang sa magiging parusa sa mga gagawa ng alinman sa naturang mga offense ay pagkakulong ng mula anim hanggang 12 taon at multang mula P50,000 hanggang P500,000. Ang mga gagamit ng bata sa cybersex crime ay may dagdag pang parusang kakaharapin sa ilalim ng Republic Act 9775 o Anti-Child Pornography Act of 2009.

Ayon kay Jinggoy, “Internet technology has gone a long way after its first invention in the 1960s… it evolved from a basic chatting service to exchange information and scientific researches into a giant cybermall offering services and products of all shapes and sizes from all over the world. The possibilities of internet techno­logy are almost boundless and limitless. Yet, with all its infinite possibilities come the limitless problems and conflicts… “ Dagdag niya, kailangang gumawa ng sapat na hakbang upang maiwasang magamit ang teknolohiyang ito sa krimen.
