The reversal by Acting Justice Secretary Alberto Agra of the DOJ decision absolving the officers and former officers of the National Press Club from the charges of qualified theft is an “AGRAVATING REVENGE” in response to the NPC’s act of condemning him to the hilt for absolving Autonomous Region for Muslim Mindanao (ARMM) Governor Zaldy Ampatuan and Akmad Ampatuan from the infamous Maguindanao Massacre that killed 57, including 32 journalists, on November 23, 2009.
Nevertheless, the NPC officers and former officers involved will file a motion for reconsideration from the said resolution of Agra to stress that he committed grave abuse of discretion for it is wrong to reverse the decision of former Justice Secretary Raul Gonzalez that there was no qualified theft.
The biggest proof that the officers and former officers of the NPC did not commit act of theft is the decision of the Regional Trial Court of Pasay City, Branch 112, in Government Service Insurance System (GSIS) vs NPC, Civil Case No. 07-1002-CFM, which ruled that the NPC building and the Manansala mural found inside the tenement belong to the NPC and not to the GSIS.
How can then the NPC as the owner represented by its officers steal its own property?
If there is anything that can explain “the last aggravating act” of Agra it is the fact that he resented the NPC’s act of staging rallies in front of the DOJ and other protest actions condemning boldly his ruling absolving the two Ampatuans from the massacre.
NPC has been the boldest of all sectors that resented the said ruling on the most brutal single assault against the Freedom of the Press.
