"May agimat ba si Lacson?"

NOONG nakaraang Biyernes ay inilathala ko ang ilang sa mga importanteng bahagi sa desisyon ni Judge Theresa Dela Torre-Yadao ng Regioal Trial Court, Branch 81 ng Quezon City.

Sa pagpapatuloy ng ikalawang bahagi, basahin natin ang dalawa pa sa apat na testimonya na inihain ng prosecution.

3. Medes Affidavit dated April 24, 2001

Medes stated that his affidavit is intended to corroborate the allegations of Ramos’ affidavit dated March 24, 2001. He alleges that on May 17, 1995, he was told to join a police operation of Task Force Limbas, Traffic Management Group against the Kuratong Baleleng Group whose members at that time were holed up in a safehouse in Superville Subdivision, Parañaque, that he and P/Insp. Ramos went to the place with other police operatives; that sometime after they arrives, a V-150 rammed the gate of the safehouse; that upon instructions of P/CSupt Zubia, they entered the compound and saw inside the safehouse the members of Kuratong Baleleng sprawled on the floor, that they saw P/Csupt. Panfilo Lacson arrive and conferred with Zubia, they brought the suspects to Camp Crame; that Zubia called for a meeting inside the office of the Traffic Management Group attended by Ramos and other police officers; that after the meeting, Ramos told him that they would bring the arrested suspects to Commonwealth and they already knew what to do because this was the order of Zubia; that at dawn of May 18, 1995, they brought the suspects to Commonwealth Avenue where the executed the plan to shoot the suspects as ordered by Lacson, Acop and Zubia; that they also implemented the verbal instruction of P/Sinsp. Glenn Dumlao who said that his (Dumlao) group will own responsibility for the killings and will make it appear as a shoot-out.

As can be seen, most of what Medes said are clearly second-hand informations coming from Ramos. For instance, he was not present during the meeting inside the TMG office but he said that the order to kill the suspects came from Zubia. Later, he said that the order was given by Lacson, Acop and Zubia. How he learned about this he did not say. Still later, he said he received orders from Dumlao but what those orders were hazy. And likewise hazy is: who killed the suspects? Was it the Ramos/Medes group or the Glenn Dumalao group?

The counter affidavit earlier executed by Medes, dated April 1, 1996, completely unmasks his later affidavit dated April 24, 2001 as a patent fabrication that should not have been given any merit by the DOJ panel of prosecutors. By recklessly disregarding Medes’ counter-affidavit, the DOJ panel showed its prejudice and committed manifest error constituting grave abuse of discretion.

As previously mentioned, Ramos and Medes belatedly executed a joint affidavit in which they stated that their perspective counter-affidavit was not prepared by them but signed the same presence of Zubia knowing that lying is against the law. But as already stated, this was nothing but feeble and crude attempt to avoid prosecution for perjury.

Habang sinusulat ang artikulong ito, inamin ni Judge Yadao na may nagpre-pressure daw sa kanya upang maglabas ng warrant-of-arrest laban sa mga akusado sa Kuratong Baleleng case.

Umariba naman ang mga nasa panig ng administration at prosecution na dapat pangalanan ni Judge Yadao kung sinu-sino ang mga taong ito. Sa ganun paraan, maparusahan naman ang may mga kasalanan at malinis ang walang kinalaman. Lubhang kontrobersyal ang kaso ng "Kuratong Baleleng."
