Korte kay Darryl Yap: Teaser ng ‘Pepsi Paloma’ alisin
MANILA, Philippines — Pinatatanggal ng Muntinlupa Regional Trial Court sa film maker na si Darryl Yap sa mga online platforms ang teaser ng pelikulang “The Rapist of Pepsi Paloma”.
Ito’y matapos na katigan ng Muntinlupa RTC Branch 205 ang motion on writ of habeas data ng TV host at komedyanteng si Vic Sotto.
Sa desisyon ng Muntinlupa RTC Branch 205 na may petsang Enero 24, 2025, inatasan si Yap na tanggalin ang teaser video ng pelikulang “The Rapists of Pepsi Paloma” sa lahat ng online platforms.
Gayunman, sinabi ng korte na pinahihintulutan pa rin si Yap na ipagpatuloy ang paggawa at pagpapalabas ng pelikula.
“The Petition for a Writ of Habeas Data filed by Petitioner Marvic “Vic” Castelo Sotto is hereby partially granted.
“Respondent Darryl Ray Spyke B. Yap and any person or entity acting on his behalf, including the production team of Vin Centiments, are Ordered to delete, take down and remove the 26-second teaser video from online platforms, social media, or any medium for having misused the collected data/information by presenting a conversation between two deceased individuals, which cannot be verified as as having actually occurred. The respondent is however allowed to proceed with the production and eventual release of the film “The Rapists of Pepsi Paloma,” saad sa kautusan.
Samantala, inihayag ni Atty. Enrique Dela Cruz Jr.,abugado ni Sotto na nagpapasalamat sila sa desisyon ng Muntinlupa court at ngayon ay magpo-pokus na lang sa reklamong cyber libel na inihain laban kay Yap.
Matatandaang unang inihain sa korte ni Sotto ang writ at sinundan ng pagsasampa ng reklamong 19 counts ng cyber libel laban kay Yap.
