MANILA, Philippines — The Makati City prosecutor’s office has indicted a businessman accused of killing a family driver during a road rage shooting along the EDSA-Ayala tunnel last week.

Col. Jean Fajardo, Philippine National Police (PNP) spokesperson, said yesterday the office of the city prosecutor found probable cause that led to the filing of the charges of murder and violation of Republic Act 10591 or the Comprehensive Law on Firearms and Ammunition against Gerrard Raymund Yu before the Makati Regional Trial Court.

Citing excerpts from the prosecutor’s resolution, Fajardo said there was treachery on Yu’s part when he shot at a Toyota Innova multi-purpose vehicle along the southbound lane of EDSA and killed the driver, 65-year-old Aniceto Mateo.

“Sinasabi ng ating prosecutor ay talagang hinabol at sigurado niya na pumuwesto siya dito sa kanang bahagi ng Innova in such a way na hindi siya mapapansin nitong driver nung siya ay putukan (The prosecutor said he gave chase and made sure to position himself on the right side of the Innova in such a way the driver would not see him when he fired),” Fajardo said in a news briefing.

Another factor, Fajardo said, is that Yu tested positive for gunpowder nitrates, which proved that he used a firearm.

The bullet casing recovered at the scene of the shooting also matched one of the two firearms recovered from Yu.

Fajardo said the prosecutor appreciated the attending circumstances and agreed with the charge of murder.

Yu earlier denied he was involved in the shooting incident.

“I’m asking the public, please don’t judge me,” he said in a video posted by dzBB.
