MANILA, Philippines — The Philippine National Police would establish committees to review cases filed by the PNP that were dismissed in court, an official said yesterday.

According to PNP spokesperson Col. Jean Fajardo, the creation of these committees follows the issuance of Department of Justice (DOJ) Circular 20, which mandates a closer collaboration between prosecutors and police officers to ensure a stronger case buildup.

“Before filing a case, we will sit down and dialogue with prosecutors to ensure a reasonable certainty of conviction, not just probable cause,” Fajardo said in Filipino in an interview over dzBB.

She added that the committees would examine the grounds for dismissal of cases, especially those involving anti-drug operations, where violations of the chain of custody are a significant issue.

“The law is very strict about maintaining the integrity of confiscated drugs from the time of seizure. It must be documented, marked and witnessed by barangay officials, a DOJ representative and media personnel,” Fajardo said.

To address these issues, Fajardo said that the PNP would call in officers involved in dismissed cases for refresher courses, particularly new investigators.

She noted that it is crucial to guide investigators, especially in cases involving serious crimes like murder or robbery, to ensure that the elements of the crime are properly established.

Fajardo emphasized that all investigators must be highly capable and competent.

“Before being designated as an investigator, one must be a graduate of an investigation course and have handled cases resulting in convictions,” she said.
