Kris Aquino's qualified theft rap against business manager Falcis junked
MANILA, Philippines — The Makati Prosecutor’s Office dismissed the qualified theft complaint filed by television and social media personality Kris Aquino against her former business partner, Nicko Falcis, for lack of probable cause.
Aquino had accused Falcis of using a credit card issued for the operations of production outfit Kristina C. Aquino Production (KCAP) for his personal expenses. She claimed that Falcis charged over P1 million to a BDO corporate card without her consent.
The actress filed theft complaints against him in seven cities, including Makati.
In a resolution dated February 18, the Makati Prosecutor’s Office said it “found no probable cause to charge Falcis” of qualified theft.
It said the credit card was issued in Falcis’ name so “he can use the same card subject to the terms and conditions imposed by BDO for the issuance of said card.”
“Given the foregoing, Falcis’ use of the KCAP card for his personal expenditures would not make him liable for theft. He is only liable to BDO for the card transactions that he had made using the card,” Makati Prosecutor Office said.
It also noted that “the fact that Aquino paid Falcis’ credit card bill is of no moment.”
“This will only make that [Falcis] civilly liable to [Aquino] as “she is entitled to reimbursement for the amount that she has paid.”
Aquino earlier alleged that Falcis made 13 transactions using the KCAP card in Makati, which amounted to P404,794. — Gaea Katreena Cabico
