Ex-Cagayan de Oro City mayor faces raps for ignoring CSC order

MANILA, Philippines - The Office of the Ombudsman has ordered the filing of charges against a former mayor of Cagayan de Oro City for allegedly refusing to follow an order of the Civil Service Commission (CSC). 

Vicente Emano is facing indictment for alleged violation of Executive Order 292 or the Revised Administrative Code of 1987.

Emano’s case stemmed from a complaint filed by administrative assistant III Leonor Esparcia who opposed her transfer to the city library as a watchman, saying it resulted in the diminution of her rank. 

The CSC said Esparcia should be reinstated to her original position.

Ombudsman Conchita Carpio-Morales said Emano’s failure to appeal the CSC decision within the prescribed period rendered it final and executory. 

Morales said Section 67, Book 5 of EO 292 imputes criminal liability against any person who violates or refuses to comply with its provisions and implementing rules.

“As respondent willfully refused to implement it…the penal clause of EO 292 applies,” she said.
