BCDA urged to respect ruling on Baguio camp case
MANILA, Philippines - The developer of Camp John Hay in Baguio City has slammed the Bases Conversion and Development Authority (BCDA) for allegedly twisting a recent ruling of the Court of Appeals (CA) stopping the eviction of investors at the camp.
The Camp John Hay Development Corp. (CJHDevCo) urged the BCDA to respect the CA decision instead of confusing the public.
“There is nothing irregular about the decision ordering BCDA not to end the contracts of the investors occupying the leased premises. The CA decision affirmed the arbitration award, which the BCDA has been trying to modify,” CJHDevCo executive vice president Alfredo Yñiguez III said in a memorandum issued late last week.
Yñiguez said the CA ruling upheld the position of the property developer that all third parties acted in good faith when they entered into contracts with CJHDevCo.
He said the ruling showed that the third party residents and locators could not simply be evicted by the BCDA.
