MANILA, Philippines - The Supreme Court (SC) has affirmed the Commission on Elections' (Comelec) resolution, declaring mayoralty bet Homer Saquilayan as the duly-elected mayor of Imus, Cavite during the May 2010 polls.
SC information chief Theodore Te said the magistrates voted 8-7, dismissing the petition of Emmanuel Maliksi, questioning the Comelec's resolution which declared Saquilayan as the winner in the 2010 mayoralty race in Imus.
Te said that with the junking of Maliksi's petition, the SC effectively lifted the temporary restraining order against Saquilayan from assuming the post.
"The decision is immediately executory considering that there are only less than five months left in Saquilayan's term of office," Te added.
