MANILA, Philippines - The Court of Appeals (CA) has junked the bid of former Bulacan vice governor Wilhelmino Sy-Alvarado to get a share in the income from the utilization and development of water derived from Angat Dam since 1992.
In a 13-page ruling penned by Associate Justice Josefina Guevara-Salonga, the CA’s Special Fourth Division dismissed the petition of Alvarado and a number of residents seeking the nullification of an earlier memorandum of agreement (MOA) between the provincial government and the Metropolitan Waterworks and Sewerage System (MWSS) that junked their claim.
The CA held that the Malolos City regional trial court was correct in dismissing the complaint filed by Alvarado’s group, as it was premature.
While the agreement had been signed by representatives of the MWSS and the provincial government, the CA said it remains ineffective and unenforceable.
It said the MOA’s effectivity is still subject to a number of conditions, which if not complied with would render the agreement invalid.
