Murder ruled out in death of activist's kin

MANILA, Philippines – Police have ruled out murder in the death of a cousin of a slain Aklan councilor and militant after forensic examination revealed that a bullet from his own gun killed him during an accidental firing.

Based on forensic examination, Zosimo Baldomero, cousin of slain activist Ferdinand Baldomero, suffered a wound in the chin from a bullet fired from his own 9-mm machine pistol, said Director Raul Bacalzo, chief of Task Force Usig.

Zosimo was found dead beside a tree in Malinao, Aklan last July 16 and his death was initially suspected to be related to the July 5 ambush of his cousin Fernando, the first militant slain under the Aquino administration.

Bacalzo said paraffin test also showed that Zosimo was positive for gunpowder nitrate, while his three drinking buddies tested negative.

Zosimo’s pistol was also found positive for gunpowder residue, he added.

“Hopefully, we can wrap up the investigation to include the affidavits of all witnesses that need to be subscribed,” Bacalzo said.

Police said Zosimo and his friends were having a drinking spree when he told them that he would relieve himself. Zosimo was then carrying his pistol and another gun, a caliber .357, tucked in his waist.

About a minute later, Zosimo’s companions heard gunshots but just dismissed these as indiscriminate firing in the area. Zosimo’s body was discovered the following morning.

Chief Superintendent Samuel Pagdilao Jr., Western Visayas police director, said one of Zosimo’s companions confessed that he hid his two guns when he saw him lifeless.
