BAGUIO CITY – The Court of Appeals recently junked the appeal by former Baguio City Mayor Braulio Yaranon regarding Malacañang’s order to suspend the local official last year.
In a three-page resolution, penned by Associate Justice Jose Sabio Jr., the CA’s 8th Division dismissed the petition of Yaranon who questioned his six months suspension since the petitioner had lost his seat as city mayor in the last elections.
Appellate court Justices Noel Tijam and Myrna Dimaranan-Vidal concurred with the ruling.
The CA said that the case of Yaranon is now considered moot and academic and would pave the way for the dismissal of the case.
“In the instant case, petitioner lost the mayoralty race in the last elections conducted on May 14, 2007. Applying the same principle enunciated in the Crespo case, this court is left without recourse but to dismiss the petition.”
