CA gives way to Bibit transfer

The Court of Appeals (CA) restrained a judge of the Olongapo City Regional Trial Court (RTC) yesterday from enforcing a writ of preliminary injunction he issued against the transfer of Customs district collector Billy Bibit from the district port of Subic to Clark.
The appellate court, in a Feb. 19 resolution penned by Associate Justice Elvi John Asuncion, ordered RTC Branch 72 Judge Eliodoro Ubiadas to stop further action on Bibits special civil action and not to enforce the writ he issued last Dec. 27.
Lawyer James Enriquez, chief of the appellate division of the Bureau of Customs Legal Service, said the CA order removes any legal impediment for Felipe Bartolome to assume as Subic district collector and for Bibits transfer to Clark.
