MANILA, Philippines - The Department of Justice (DOJ) has cleared former National Bureau of Investigation director Magtanggol Gatdula of criminal charges in connection with the botched ambush on NBI deputy director Reynaldo Esmeralda two years ago.
In a 27-page resolution released yesterday, the investigating panel of prosecutors dismissed for lack of probable cause the complaint for two counts of frustrated murder with treachery, evident premeditation and use of illegal firearms filed by the NBI against Gatdula.
The DOJ panel, led by Assistant State Prosecutor Gino Paolo Santiago, also cleared driver Gino Eustaquio.
The panel, however, recommended the filing of attempted murder charges against the other respondents identified as businessman Tyrone Ong, former police officer Perfecto Villanueva, Ronnie Ong, Ramoso Ramos, Alfredo Compoc, Teodoro Abendano, Ricky Dacillo, Gerry Farillon, confidential agent Jose Maglalang Jr., Jun Monticlaros and Alvin Monticlaros.
Gatdula was implicated in the case by retired police officer Perfecto Villanueva, who earlier admitted before the NBI that he was the one asked to lead the killing of Esmeralda.
