CA upholds acquittal of ‘Alabang Boys’

Edu Punay - The Philippine Star

MANILA, Philippines - The Court of Appeals (CA) has upheld the acquittal of two drug suspects arrested by the Philippine Drug Enforcement Agency (PDEA) in Ayala Alabang Village in September 2008.

In a 23-page decision released yesterday, the CA Special 4th Division denied the petition filed by the Office of the Solicitor General seeking the reversal of the verdict handed down by Muntinlupa City Regional Trial Court Judge Juanita Guerrero on Aug. 26, 2011.

The lower court acquitted “Alabang Boys” Richard Brodett and Jorge Joseph of the drug charges due to the failure of the prosecution to prove their guilt beyond reasonable doubt.

The CA held that there was no proof that the Muntinlupa court committed grave abuse of discretion that would warrant the reversal of the acquittal of Brodett and Joseph.
