DOJ ends probe on 2 missing UP activists

MANILA, Philippines - The Department of Justice (DOJ) concluded yesterday its preliminary investigation into the alleged involvement of retired Army Maj. Gen. Jovito Palparan in the disappearance of two missing University of the Philippines student activists five years ago.

The panel chaired by Assistant State Prosecutor Juan Pedro Navera moved to submit the complaint filed by the mothers of Sherlyn Cadapan and Karen Empeño for resolution upon submission of memoranda by parties within 15 days.

Palparan is accused of rape, serious physical injuries, arbitrary detention, maltreatment of prisoners, grave threats, grave coercion, and violation of Republic Act No. 7438 or the Act Defining the Rights of Persons Arrested, Detained, or Under Custodial Investigation.

Army Staff Sergeant Edgardo Osorio; Lt. Col. Rogelio Boac, commanding officer of the 56th Infantry Battalion; Lt. Col. Felipe Anotado, commanding officer of the 25th Infantry Battalion; , 2 nd Lt. Francis Mirabelle Samson; retired M/Sgt. Rizal Hilario; and retired M/Sgt. Donald Caigas of the 24th Infantry Battalion, were also named respondents in the case.

“While the abduction of Sherlyn and Karen were carried out by unnamed elements of the 56th Infantry Battalion of the Philippine Army, it was clearly established that they were detained under the custody of the 24th Infantry Battalion and were tortured and raped by and under the knowledge and order of (Caiagas and Hilario),” the mothers of the missing students said.
