PBA player asked to file counter-affidavit

MANILA, Philippines - A trial court has ordered basketball player Wynne Arboleda to file within 10 days his counter-affidavit to the slight physical injuries case filed against him by a fan.

Judge Alfredo Ampuan of Quezon City Metropolitan Trial Court Branch 33 also told the basketball player to submit affidavits of his possible witnesses.

The order was sent on Oct. 4 to Arboleda, who plays for Air21 in the Philippine Basketball Association.

Court staff said he has yet to comply with the order.

The prosecution was also told to submit within 10 days its reply to Arboleda’s counter-affidavit.

“The issue to whether or not the case shall be dismissed or set for arraignment and trial shall be deemed submitted for resolution upon submission of the last affidavit or the lapse of 10 days from receipt of information and affidavits of witnesses.”

Arboleda was charged in court for allegedly beating up a fan, Allan Katigbac, during a game between then Burger King and Smart Gilas in October last year at the Araneta Coliseum.

Arboleda allegedly committed several fouls against players of the other team, for which he was booed by some fans. Katigbac joined in booing Arboleda. Katigbac claimed Arboleda allegedly kicked and punched him.
