Nurse submits proof in botched procedure case vs Belo

MANILA, Philippines - A US-based nurse, who earlier filed a complaint for reckless imprudence resulting in serious physical injuries against cosmetic surgeons Dr. Victoria Belo and Dr. Jennifer Sison-de Leon, yesterday filed her supplemental complaint-affidavit before the Makati City Prosecutor’s Office.

Leila Palaganas also attached medical certificates issued by De Leon dated July 16, 2008, where she wrote that Palaganas underwent Thermage on July 8, 2008 and had developed blistering “mostly on her right (cheek) and is currently being treated with Burrow’s Compress and Laser Cream.”

Thermage is a non-surgical procedure that employs a patented radiofrequency (RF) technology called ThermaCool, according to the website of the Belo Medical Group, to tighten and gently lift skin to smooth out wrinkles and define facial contours.

Palaganas said despite being treated with Burrow’s Compress and Laser Cream, scars developed on her face, prompting her to file the lawsuit last Feb. 20.

According to Palaganas’ lawyer, Arnold Naval, his client is also suing the Belo Medical Group for P20 million in damages.

In the affidavit, submitted to Assistant City Prosecutor Edgardo Hirang, Palaganas said she had lost her self-confidence due to the permanent scars and dark marks caused by the alleged botched Thermage procedure.

Palaganas, who works at the front desk of the Rahway Hospital’s operating room in New Jersey, said Belo – as the managing director of the Belo Medical Group, Inc. – allowed De Leon to perform the procedure on her even if she is not a certified Thermage practitioner.

“Clearly, in allowing (De Leon) to do the procedure, Dr. Belo has given her consent and has approved the acts and omissions of (De Leon),” Palaganas said. – Mike Frialde
