Gabby sued for endorsing rival beauty product

A columnist and television host filed yesterday a P2.8-million damage suit against movie actor Gabby Concepcion and his manager for alleged breach of contract in the endorsement of a whitening product.

Jobert Sucaldito alleged in his complaint filed before the Quezon City regional trial court that Concepcion agreed in principle to endorse Met Tathione products in exchange for a P2.5-million fee and a 56-inch plasma television.

However, he alleged that Rose Flaminiano, the actor’s manager, negotiated with a rival firm, which offered P5 million. 

Sucaldito alleged that Flaminiano arranged a meeting and, after giving him a P20,000 gift, told him that there was a problem with the earlier endorsement because Concepcion had already signed a P5 million contract to endorse Lucida beauty products.

Sucaldito alleged that the refusal of Concepcion and his manager to honor the earlier agreement has shattered his image and his reputation has become questionable.

The complainant’s lawyer, Jorge Miravite, said that even though his client and Concepcion only had a verbal agreement, it is still legally considered as a perfected contract. He also claimed that his client was badly hurt by Concepcion’s betrayal, since the two have been long-time friends.

Sucaldito is seeking P2 million in moral damages, P500,000 in exemplary damages, P200,000 for attorney’s fees and P100,000 as litigation expenses.
