Smear campaign vs 2 Munti judges hit

A group of Muntinlupa lawyers has deplored the dirty tactics employed against two Muntinlupa judges, Alberto Lerma and Norma Perello, who have been subjected to false media reports claiming that they are facing administrative charges.

"Lerma and Perello are two of the most respected judges in Muntinlupa. They are not facing any administrative charges before the Supreme Court. Contrary to reports, the judges were not suspended. In fact, they are performing their duties and going to work everyday," said the lawyers.

According to false reports, the judges received complaints for re-issuing ex-parte writs of attachment on undetermined damages. The lawyers explained that ex-parte writs of attachment are allowed under the Revised Rules of Civil Procedures as long as the requirements of the law are met, including the filing of the pertinent surety bond.

Asked who could be circulating the false reports, the lawyers said they believe a group sympathetic to a health care institution in Fairview are targeting the judges reportedly over two writs of attachments issued by Perello and Lerma against the institution.

The owners of the Asian Institute of Health Care are facing charges of unfair competition and damages with prayer for writ of attachment before the Muntinlupa Regional Trial Court in cases filed by the AMA Group of Companies. The institute’s owner, Manuel Abad, was discovered to have established rival schools while still employed and holding the second top post in the AMA Group, according to their suit.

Last May 6, the Abads’ security guards even fired at a sheriff and policemen serving a court order in their health care firm. They are now facing additional charges of attempted homicide and disobedience of lawful order before the Quezon City Prosecutor’s Office.
