Prosecutor junks suit vs. ex-barangay chief
CEBU, Philippines - For lack of evidence, the Cebu City Prosecutor's Office has dismissed the criminal complaint for alarm and scandal filed against a former barangay captain of Day-as, Cebu City.
State Prosecutor Simaco Labata said the joint-affidavit of the arresting officers as evidence is not enough to establish probable cause that Rey Elery Cañada, 50, a resident of barangay Day-as, committed the offense as charged.
Labata has recommended the immediate dismissal of the complaint, which was approved by City Prosecutor Nicolas Sellon and ordered the release of Cañada from police custody.
Cañada was arrested on November 30, 2013, at around 9:40 p.m. — (FREEMAN)
