Ombudsman orders nepotism rap vs ex-mayor of Iloilo town

MANILA, Philippines — The Office of the Ombudsman has ordered the filing of a nepotism case against former San Dionisio, Iloilo Mayor Peter Paul King Lopez for allegedly appointing his son to a career service position in 2015.
In a decision recently signed by Ombudsman Conchita Carpio Morales, Lopez was ordered charged before the Sandiganbayan for violation of Section 79 of Republic Act 7160 or the Local Government Code of the Philippines.
Section 79 of the Local Government Code prohibits the appointment of a person in a career service position in the local government if he or she is related within the fourth civil degree of consanguinity or affinity to the appointing or recommending authority.
Based on the ombudsman's investigation, Lopez on January 5, 2015, designated his son Carlos Paul as acting licensing officer of the municipality, a career position in the Civil Service.
The ombudsman said that prior to his designation as acting licensing officer, Carlos Paul was already holding a co-terminus position as his father's executive assistant.
The ombudsman said that “while Carlos was only designated as Acting Licensing Officer, the rule on Nepotism admits of no distinction between appointment and designation”.
“There is no dispute that respondent and Carlos are related to each other and the respondent designated Carlos to the position of Acting Licensing Officer of the municipality. Thus, it clearly constitutes the offense charged,” the ombudsman decision read.
The ombudsman had earlier ordered Lopez' perpetual disqualification from holding public office and the cancellation of all his retirement benefits in connection with the same alleged anomaly.
