Man indicted for posting sex photos on FB

CEBU, Philippines - For allegedly posting pictures of their intimate activities without the consent of his ex-girlfriend, the Cebu City Prosecutor’s Office has indicted a man for violating the Anti-Photo and Video Voyeurism Act.

Prosecutor II Jennifer Karen Leyson, in her penned resolution, found probable cause to charge the accused before the court after he failed to negate the allegations filed against him.

“Without any counter-affidavit submitted, the averment that the pictures and video recording of the sexual activity between the parties was made without the consent of the (complainant) remains undisputed,” the resolution read.

 “Under such intimate conduct, (complainant) clearly has reasonable expectation of privacy, which was palpably violated when the pictures were circulated without her consent. Thus, the evidence at hand supports a finding that (accused) committed the crime charged,” the resolution further reads.

The FREEMAN withholds the names of the parties due to the nature of the case.

In her complaint-affidavit, the victim, of legal age, a resident of Barangay Talamban, Cebu City, alleged she and the accused engaged in a sexual relationship after he confessed his feelings to her sometime in December 2012.

However, she put an end to their relationship in June 2015 because she was no longer comfortable with him.

In March 2016, she said several of her co-workers received nude pictures of her and the accused in their respective Facebook accounts.

After that incident, she had a talk with the accused and the latter promised to do whatever she wants as long as she will not leave him.

She alleged that when she started avoiding the accused, he created a Facebook account under her name and used her picture as profile picture and uploaded screenshots of a video of their sexual activities. (FREEMAN)
