Palace: New Supreme Court justice 'very capable'

MANILA, Philippines - Malacañang yesterday said the independence of the Supreme Court (SC) should not be doubted with the appointment of Court Administrator Jose Perez as a new associate justice.

Secretary to the Cabinet Silvestro Bello III described Perez as someone who is “very capable” and whose integrity is “beyond reproach.”

In an interview over Radyo ng Bayan, Bello said the appointment of Perez was one of the best selections ever made by President Arroyo.

“He is homegrown to the judiciary. His competence, integrity and dedication to the service of justice cannot be questioned,” said Bello, a former Justice Secretary.

Bello said the members of the judiciary are aware of their responsibility to be fair and independent despite being appointed by the president.

“These judges, while they are grateful for their being appointed by the President, the moment they enter the judiciary, they all know that they should be neutral and independent,” he said.

“They will have to dispense justice in accordance with what is supported by evidence and in accordance with due process and most of all, in accordance with the rule of law,” he added.

Perez rose from the SC ranks, starting out as a legal assistant in the Office of the Reporter after completing his law degree in 1972.

He became deputy clerk of court, then Court Administrator.

Bello said the President has not yet decided on who will occupy the last seat in the 15-member Supreme Court, which was left vacant by the retirement of Justice Minita Chico-Nazario on Dec. 5.

Bello said the president will choose based on the track record and integrity of the nominees.
