CPVDC faces plaint for illegal fencing

CEBU, Philippines - A formal complaint was filed before the Office of the Building Official after fencing works of  Cebu  Property Ventures and Development Corporation (CPVDC) continue despite order to stop.

Noticing that CPVDC did not heed the earlier order of OBO, Filinvest through ESCA Incorporated sent a formal communication asking the city government to re-inspect the site inside the IT Park.

“We would like to inform your good office on the status of CHB fencing done by CPVDC group along Geonzon St., the works are still on-going in spite of the issuance of ‘Notice of Illegal Construction’ issued by your office dated November 19, 2013,” the letter complaint signed by ESCA Inc. project manager Butchie Abaya.

The November 26 letter was accompanied with photos of actual construction works in the nearby development where Filinvest is also finishing a project.

OBO earlier issued first Notice of Illegal Construction to the “illegal fencing construction” on November 19 for violating section 301 of the National Building Code.

“No Person, firm, corporation, including agency, or instrumentality of the government shall construct, alter, repair convert, use, occupy, move, demolish, and add any building/structure or any portion thereof or cause the same to be done, without first obtaining a building permit therefore from the Building Official assigned in the place where the subject building/structure is located or to be done. The prescribed application for building permit form (NBC Form B-01) shall be used by all applicants,” paragraph 1 of Section 301 of the Code reads.

Further, the notice ordered the construction firm to immediately cease works, send a representative to connect with OBO within three days from receipt of the notice, as well as directing that they secure necessary building permit from the same office at the City Hall.— (FREEMAN)
