Kalunasan coop wants Capitol to donate lot

CEBU, Philippines - The Langub Kalunasan Multi-Purpose Cooperative has sought the help of Vice Governor Agnes Magpale for the donation of the province-owned lot it is currently occupying in Barangay Kalunasan.

 LKMPC chairman Antonio Canoy met with Magpale to personally convey his appeal to the Provincial Board to authorize Governor Hilario Davide III to execute a deed of donation for the 30-square-meter property.

 Canoy brought with him a draft resolution seeking to authorize Davide to execute the deed of donation in favor of the cooperative.

“This has to be discussed with Gov. and all SP (Sangguniang Panlalawigan) members,” Magpale said.

 Canoy claimed that Davide had already agreed to the donation during their meeting recently.

“This unfolding development is a sharp twist from avaricious recovery to a productive benevolence and liberality by incumbent Davide-Magpale administration,” Canoy said.

 He is referring to the case filed during the administration of former governor, now third district Representative Gwendolyn Garcia which is still pending before the Regional Trial Court.

 Garcia filed a case for the recovery of possession of the lot in dispute and ordered the demolition of the structures thereat.

 Canoy earlier sent an open letter to President Benigno Aquino III complaining against Municipal Trial Court in Cities Branch 6 Judge Pamela Baring-Uy whom he accused of rendering unjust judgment on a civil case filed by Garcia.

 The complaint of Canoy stemmed from the decision of Baring-Uy dated March 12, 2012 granting the Province of Cebu the recovery of the lot where the two-storey office building of the cooperative and a deep well were constructed.

 The court ordered LKMPC to vacate the portion of the said property and to pay P500 a month as reasonable value for the use and occupation of the property, starting from October 14, 2010 until the property is vacated.

 As defendant, the LKMPC claimed that the province made it appear that it intends to sell a portion of Lot 1411 when in truth it has none, even the passage of the two PB resolutions authorizing the governor to sell.

 LKMPC is serving level-3 water needs of about 500 households who are mostly employees and staff of Cebu Provincial Detention and Rehabilitation Center and the Cebu City Jail, and a thousand of residents are also served with the level-1 water supply.  (FREEMAN)
