CH snubs Talisay order, continues construction
CEBU, Philippines - Despite the issuance of a cease and desist order (CDO) by the Talisay City government for allegedly encroaching on their jurisdiction, the Cebu City government is continuing their construction in the two parcels of reclaimed lot at the South Road Properties (SRP).
“We firmly stand by our position that Talisay City cannot stop our construction,†Cebu City Attorney Jerone Castillo told reporters.
Castillo referred to Presidential Decree 1818 “Prohibiting Courts from Issuing Restraining Orders or Preliminary Injunctions in Cases Involving Infrastructures and Natural Resource Development, Projects of, and Public Utilities Operated by the Government.â€
This is the same argument used by the Cebu City government on the Mahiga Creek case, Castillo said.
He reiterated that Cebu City acquired a certificate of land title for the two lots.
Mayor Michael Rama, for his part, said his office has yet to receive his copy of the CDO.
He added that matter will be best handled by city legal and city administrator. — (FREEMAN)
