Man threatens wife who refused Sex

CEBU, Philippines - For waiving his right to undergo preliminary investigation to answer the allegations filed against him, the Cebu City Prosecutor’s Office indicted a 28-year-old man for allegedly threatening his wife.

Prosecutor Rogelio del Prado Jr. elevated the case against the accused to court for violation of Republic Act 9262 or Anti-Violence against Women and Children Act against the accused.

“The said accused, with deliberate intent, did then and there commit psychological violence on his wife by uttering threatening words likely to cause mental or emotional suffering,” the charge sheet read.

Del Prado then recommended a bail of P60,000 for the temporary liberty of the accused.

In her sworn affidavit, the 33-year-old wife of the suspect said on Oct. 29, 2012 around 5 p.m. while she was lying in their bed her husband arrived and allegedly wanted to have sex with her.

She said she refused because she was pregnant.  This allegedly irked her husband and uttered threatening words saying “sunugon tamo ug patyon, kay andam kung mamatay og mopatay (I’ll burn and kill all of you, I’m ready to die and to kill).”

She said she stood up and pushed her husband.

“I endeavored to go outside and run away, then and there I went to the barangay to report this incident and asked for their help,” her affidavit read.

She later returned home with barangay tanods who arrested her husband and brought him to the police station for investigation.  During questioning, the husband denied the allegations against him.

She said during the arrest of her husband they saw that the latter tucked a knife into the waistband of his pants.
