Toledo brgy capt. Faces charges for punching man

 CEBU, Philippines - For allegedly inflicting bodily harm on the complainant, the Office of the Ombudsman-Visayas has indicted the barangay captain of Poblacion, Toledo City.

Graft investigator Maria Fernandez recommended  the filing of slight physical injuries and grave threats against Faustino Barcenas.

Complainant Ric Bendanillo alleged on Feb. 11, 2012 at 9:30 p.m. while he was at Cockers Arena in Barangay Bato, Toledo City, the respondent suddenly approached him and confronted him.

He said for no apparent reason the respondent punched his head several times, causing injuries to his face.

“Respondent appeared to be under the influence of liquor,” he said.

Bendanillo also reportedly  tried to pull out a gun saying “I will kill you” in Cebuano, but others were able to stop him just in time.  To support his claim, he attached a medical certificate and the joint-affidavit of his witness to the police blotter.

Fernandez said based on the complaint filed it was established that the elements of slight physical injuries and grave threats were present.

She added since the penalty of imprisonment of grave threats and slight physical injuries does not exceed six months and the fine does not exceed P1,000  the case falls under summary proceedings. (FREEMAN)
